Procedure for applying for a national registration of a designation of origin / geographical indication

An application for national registration may only be submitted in respect of goods not covered by the directly applicable EU regulation – European Parliament and Council Regulation (EU) No. 1151/2012, No. 1308/2013, No. 251/2014 and 2019/787. Aplicant shall indicate in the application for registration of the designation of origin / geographical indication (the 'application')

  1. the text of the designation of origin / geographical indication;
  2. the name and, where applicable, the business name and registered office or first name, surname and place of permanent residence of the applicant and, where appropriate, their representative;
  3. the geographical delimitation of the territory in which the goods are manufactured, processed and/or prepared;
  4. the designation of the establishment producing, processing and/or preparing the goods affixed to the designation of origin / geographical indication in a place whose geographical name is part of the designation of origin / geographical indication;
  5. a list of the goods to be covered by the designation of origin / geographical indication;
  6. a description of the characteristics or qualitative characteristics of the goods which are given by a specific geographical environment.

The application shall be followed by an extract from the register kept by the public authority responsible for the territory in which the goods are manufactured, processed and/or prepared, provided that it certified that the applicant's establishment is located in the territory concerned or that the applicant produces or processes the goods.

Anyone who can apply to the Office for registration of a designation of origin or geographical indication in the register is governed by Section 5 of Act No. 452/2001 on the protection of designations of origin and geographical indications, and on the amendment of the Consumer Protection Act.

There are no time limits for proceedings before the Office on designations of origin and geographical indications.

The procedure is performed according to the following legislation:

Act No. 452/2001 on the protection of designations of origin and geographical indications, and on the amendment of the Consumer Protection Act.

Act No. 500/2004 Coll., on administrative procedure (Administrative Code), as amended.

The Office shall examine whether the designation of origin or geographical indication referred to in the application fulfils the conditions for registration and whether the application has the requirements referred to in Section 5. If the application does not have any of the specified requirements, the Office shall invite the applicant to complete the application, set a reasonable deadline which may not be less than two months, and notify them that they will otherwise stop the proceedings.

If the designation of origin / geographical indication is excluded from registration or if the designation of origin / geographical indication does not meet the conditions laid down in this Act, the Office shall reject the application.

A decision of the Office issued at first instance may be appealed to that authority within 15 days of the date of notification of the decision; a timely appeal has suspensory effect (Section 152 of Act No. 500/2004 Coll. on administrative procedure (Administrative Code), as amended).
