Notice of deadlines
Since 1 January 2019, the Industrial Property Office (hereinafter referred to as the IPO) has been sending warning letters on the expiry of the trademark registration in accordance with Section 29(1) of Act No. 441/2003 Coll., on trademarks. Trademark owners are informed no later than 6 months before the expiry of the registration period in the form of a warning letter sent to the data box of the proprietor of the trademark or their representative (if represented). If it does not have a data box, the warning letter is sent to an e-mail address. If the trademark owner does not have an e-mail address, the letter is sent by mail. In order to make a reregistration of a trademark, it is necessary to submit an application for renewal of the registration.
Failure to provide expiry information shall not give way to state liability for damage caused in the exercise of state power and shall not affect the expiry of the registration period.
The IPO also sends electronic notifications of the impending expiration of the deadline
• for the submission of an application for renewal of the design protection period
• for the submission of an application for an extension of the registration of a utility model
• for submission of an application for a full examination of the invention application
• maintenance fees for patents and European patents.
These notices shall be sent one month in advance of the expiry of the abovementioned deadline to the representatives, in the case of non-represented files, to the e-mail address available to the IPO of the applicants/owners/licensees. In case of interest in sending these notices, it is necessary to communicate the e-mail address, first name, surname and residence of the legal entity to the name and registered office of the company, to: lhuty@upv.gov.cz.
Notice of the expiry of the deadlines for submitting an application for renewal of the term of protection of the design, for the submission of an application for an extension of the registration of a utility model, for submitting an application for a full examination of the invention application and for the payment of maintenance fees for patents and European patents is only informative. Sending a notice is not a legal obligation, the IPO is not liable for the consequences of any non-delivery of the above warnings.
